CAO Promotion & Recruitment Rules for the post of Tax Assistant

Ad-II A section is yet to receive ACRs/APARs of the following 09 (Nine) Administrative  officers in connection with the promotion to the grade of Chief Accounts Officer (CAO). They have also checked the records of DGHRD.

The Zonal leaders are requested to pursue with the local Administration, so that the records are sent to CBEC at the earliest.

This undersigned during a meeting with Hon’ble Chairperson on 25.02.2014 has requested that the qualifying service for promotion to the post of Tax Assistant from LDC needs to be further relaxed from 7 years to 5 years as huge number of posts are lying vacant in the grade of Tax Assistant in many zones.

In the meanwhile the board has circulated the Tax Assistant RRs in which the qualifying service has been enhanced from 5 years to 8 years (in terms of DoP&T instruction).  Further in the notification, the minimum educational qualification for LDCs will be Higher Secondary and Combined regular service in the grade of LDC and Head Havaldar shall be taken into consideration for qualifying service.

However, the Ministry has failed to take into consideration of the DOP&T's general guidelines on Framing / Amendment / Relaxation of Recruitment Rules PART-III vide (DOPT OM No. AB 14017/66/2008-Estt (RR) dated 9.3.2009) which is reproduced below

RETENTION OF EXISTING ELIGIBILITY SERVICE

3.1.3 Where the eligibility service for promotion prescribed in the existing rules is being enhanced (to be in conformity with the guidelines issues by this Department) and the change is likely to affect adversely some persons holding the feeder grade posts on regular basis, a note to the effect that the eligibility service shall continue to be the same for persons holding the feeder posts on regular basis on the date of notification of the revised rules, could be included in the revised rules.

It appears that the Ministry has erroneously mentioned Head Havaldar instead of Havaldar for calculation of combined service in the grade of LDC for further promotion to the grade of Tax Assistants.

This association has been repeatedly addressing the board for initiating a consultation process with this association prior to any amendment in the Recruitment Rules.

A BREIF REPORT ON MEETING WITH REVENUE SECRETARY

OUR VISIT TO DELHI DURING 10TH TO 12TH  September, 2013 –
A BREIF REPORT

The highlight of the recent visit of the office bearers of this Association with Revenue Secretary and Hon’ble Chairperson of CBEC on 12/9/2013 at 4 p.m. and 5.30 p.m. respectively. The following points were taken up for discussion in accordance with a pre determined agenda:-

(1) Promotions to CAO:-  In the face of vigorous persuasion of this Association, it was assured that one DPC for the years 2010-11, 2011-12, 2012-13 and 2013-14 is most likely to be held in very soon. 

(2) All India Seniority list of A.O.:-  DGHRD is updating the All India Seniority list of A.O.  as on 31.12.2008 again. In this connection, the DGHRD has requested vide letter F.No.8/B/67/HRD(HRM)2011 dated 12.09.2013 to all Cadre Controlling Authorities to forward the seniority list of AO of their respective Zones.


(3) Recruitment Rule of A.O.:– It has been informed that Recruitment        Rule of A.O. has been sent to the Law Ministry and presently lying for translation to Hindi, following which it will go for notification in the official Gazette. 

(4) Pay Scales for A.O.: – It was pointed out by the leadership that Department of Expenditure is making certain submissions in the court of law through which they have acceded to the recommendation concerning parity between Headquarters organization and field formations like us. Board may take up the issue afresh with Department of Expenditure on the basis of their submissions before judicial fora.  Revenue Secretary has been very kind to accept our request and directed to do the needful.

(5)  Recruitment Rule of Inspector and age relaxation: - The Association vehemently argued for incorporation of a suitable clause in the new RR to protect the qualifying service i.e. – 2 years of present STAs & 10 years of TAs and Stenographers as well in terms of the DoPT’s guidelines.  It was also requested to remove age bar together and extent their facilities even before notification of new RR.  The Hon’ble Chairperson has been very kind to appreciate the Board for incorporation of a suitable provision for retention of the present qualifying service in the new RR and issued necessary direction to the concerned officers.  On age relaxation also, the response was positive.  We have submitted a separate representation seeking age relaxation even before notification of new RR.


(6)  Cadre Restructuring:-  The leadership pointed out that nothing has been conveyed to this Association on Cadre Restructuring proposals which has been altered many a times in the recent past.  The Revenue Secretary advised to submit a representation on this issue.  Subsequently, this Association was able to submit a representation with 4 tier structure of A.O. to the Revenue Secretary with a copy to Chairperson.  The Cadre-restructuring file is still pending with Committees of Secretaries and once it is cleared it will be sent to Cabinet.

(7) 100% promotion to the grade of Inspector : This Association was able to submit a representation for 100% Promotion to the grade of Inspector in the ongoing Cadre Restructuring to the Revenue Secretary with a copy to Chairperson.

The leadership of this Association also pursued DGHRD officials for preparation of All India Seniority list of A.O. and an early date of the CAO DPC  Besides we move around all the concerned administrative sections Ad.IIA & Ad.IIIB of CBEC and met the officials to pursue our issues, detailed above.  Over all it was a pretty successful tour which has engendered some kind of optimism.

Further it is informed that the Recruitment Rules for the post of Administrative Officer will be notified at the earliest.

The President along with Assistant Secretary General and Organizing Secretary met Revenue Secretary and Chairman on 12.09.2013 regarding various issues related to Ministerial Cadre.  Details of the Delhi visit will be updated soon.

RECENT DEVELOPMENTS

 Dear Members,

As stated in the earlier message, the file relating to the DPC for promotion to the grade of Chief Accounts Officer, has again been returned by the UPSC pointing out some deficiencies.  Firstly, this Association shares the concern of all its members who are aspiring to become a Chief Accounts Officer in the Department but who are possibly by now tired of the UPSC’s delaying tactics by time and again identifying discrepancies.  Needless to mention, if the UPSC had consolidated the discrepancies and informed the Board on time, by now all the discrepancies could have been taken care of and a date could have been fixed for holding DPC.  It is apparent that the information required has either not been provided to the UPSC by the Board, which ought to have been aided by the concerned cadre controlling authorities. Despite the above fact, this Association expects that the Board will surely put in genuine efforts in getting this file cleared, by putting in the same kind of attention as in the case of other Group ‘A’ posts. It is now expected that the Administrative Officers who are at the helm of affairs and related to the issue directly or indirectly, in compiling/forwarding the relevant information will rise to the occasion and provide all the requisite particulars and leave no room for the Board/UPSC to raise any further objections in the matter and thereby facilitate, early decision in the matter.  At this juncture, I would like to personally seek genuine assistance from the office bearers of Local units in reaching the information to the Board at the earliest possible time.  Please do note that any information passed on to the Board may be got acknowledged so as to ensure that the information reaches UPSC in time.
 
          The issue relating to framing of RRs is another important subject, on which this Association was keeping a close watch on. It is learnt that the proposal for revising/ amending the RRs of certain cadres had taken precedence/priority over other RRs like, CAO, AO, AC and Superintendents, which required the immediate attention of the Board.  Instead of covering up the various lacunae that exist in the existing RRs by taking remedial measures, attempts are on to frame and notify certain RRs without even consulting this Association. In this background, a letter has been submitted to the Hon’ble Chairman, bringing to his notice the various issues that require his immediate attention/intervention, apart from requesting him to initiate a consultative process, before finalization of the Recruitment Rules. The Chairman was of the view that a consultation process is a must, and assured that the demands will be looked into positively. Copy of the said letter can be accessed by clicking here.

          Most of you might be aware that as per the existing RRs the upper age limit for promotion to the grade of Inspectors is 50 years. Few of our aggrieved members had challenged this provision before the Hon’ble Tribunal, Chandigarh, which has rendered a favourable verdict, a verdict that has been upheld by the Hon’ble High Court of Punjab and Haryana by holding that RRs does not prescribe any upper age limit for promotion as Inspector. The age limit is restricted to only for appearing in the Departmental Examination for promotion. The Board has decided to accept and implement the judgement and extend the benefit to all similarly placed officers. The Officers who were denied promotion after the notification of existing RRs i.e., after 07.12.2002, may take up the matter with the concerned cadre controlling authorities.  Concerted efforts have yielded the desired results and benefits can be availed of by all the aggrieved officers who were denied their legitimate promotion for some reason or their other post 07.12.2002 as per the provisions of the Notified Recruitment Rules, 2002.   Copy of the order can be accessed by clicking here.

          Before concluding my message, may I keep all the learned members of this Association informed that the issue relating to downgradation of DOS posts to that of STA and getting the same filled from eligible Tax Assistants is being spoken about by projecting the issue differently.  I shall appreciate comments/ opinions in this matter directly from all those learned members of our cadre on e-mail id monythom@gmail.com so as to bring in clarity on the issue.  Incase I do not receive any mails I shall be putting up details in the subsequent message likely to be sent from my end next week.
