VISIT TO DELHI FROM 01st DEC, 2015 TO 03rd DEC, 2015

Dear Comrades,

       In continuation to my earlier message, I would like to share the following about my visit to Delhi, along with Shri Ram Lalit and Shri Prosenjit Pandey,  during 01st Dec 2015 to 03rd Dec 2015:


   The meeting with Member (P&V) lasted for more than an hour. Even though she told us that she would discuss only on the main agenda that is ‘withdrawal / amendment of RR of EA’, we could talk on other pending issues too. Madam was not ready to agree that the RR was finalized unilaterally, but our side once again stressed that the stakeholders were not given an opportunity to be heard before finalizing the said RR, hence the framing guidelines of RR given by DoPT was not followed. We also put forth that CBDT still follows the old RR and even the draft RR for EA in CBDT, has three years as qualifying service as Tax Assistant. Other points, like comparison between MACP and promotion, currency of 6th CPC, joining of this service by freshers leaving other organisation etc., were also brought forward during the discussion. In a nutshell, our side vehemently opposed the publication of new RR of EA, which would spoil the career of existing TAs and also who are about to join. She instructed Joint Secretary (Admin) to examine the issue and take up this with other authorities like DoPT etc.

          Madam was informed about the confusion created in some zones over the issue of letter by Board on 17th September 2015 and subsequent publication of RR of EA on 28th September 2015. She was of the opinion that pre-restructured vacancies can still be filled up on the basis of old/existing RR.

   This association put the demand that with regard to the promotion to TA from LDC, while counting the service of Havaldar, the service rendered as Sepoy, before being re-designated as Havaldar, should also be counted. Member (P&V) responded in a positive manner. We requested to issue an Order on this issue.

     With regard to the DPC for promotion to CAO, this association expressed its deep concern over the delay. Member (P&V) said that she would look into the matter and make it happen at the earliest. However, it was pointed out that reply from various zones on VC/IC were pending, causing the delay. Zonal leaders are requested to follow up the matter in their respective zones.  D.O. letter issued by Member (P&V) on this front is linked herewith - D.O. Letter & Annexure-III.

   On our demand to meet Hon’ble Chairman, CBEC to explain the seriousness of the issue of RR of EA, madam took us to Chairman and matter was discussed with the Chairman, CBEC.

    We also met concerned Deputy Secretaries and Under Secretaries in the Board to pursue different issues and requested to move the files to higher level officers for early action.

    We visited the office of DGHRD to find out the status of finalization of seniority list of A.O.s from the year 01.01.2009 to 30.06.2014.  It is learnt that many zones have not sent the filled up proforma as desired by the DGHRD letter having F. No. 8/B/187/HRD (HRM)/2014 dated 18.11.2015 (CLICK TO DOWNLOAD PAGE-1, PAGE-2 & PAGE-3) along with the seniority list of the respective zones.   All the zonal leaders are requested to take up the matter with concerned authorities and send the filled up proforma with signature, at the earliest. VISIT TO DELHI FROM 01.12.2015 TO 03.12.2015

    Myself along with Shri Ram Lalit, Assistant Secretary General (Additional charge of Liaison Secretary) and Shri Prosenjit Pandey, General Secretary of West Bengal, Andaman & Nicobar Unit during our visit to Board Office, we have meetings with Hon'ble Chairman, Hon'ble Member (P&V) and other Senior Officers in Ad-IIIA/B Sections and have submitted the following letters (CLICK TO DOWNLOAD - 50YRS-PAGE-1 PAGE-2CAO-DPC, EA-RR-PAGE-1 PAGE-2RR-HAVALDAR & RLXN-AO-STA-TA):  Tomorrow we will have other important meetings and related works to the issues of Relaxation in the RR of Inspector, CAO DPC, Promotion to the grade of Inspector after 50 years etc. in different sections of Board offices. Visit to Delhi on 16th October 2015

Dear Comrades,

      Myself along with Shri Ram Lalit, Assistant Secretary General (additional charge of Liaison Secretary) and Shri Prabhakar Kr. Singh, member of Kolkata zonal Committee, had a visit to Delhi and met honourable (Member P&V), CBEC. Appointment was sought from honourable Minister of State for Finance, the Revenue Secretary and the Chairman, CBEC (Click here to see our appointment letter & appointment letter). However, honourable Member (P&V), wanted to have a discussion with this association on the issues mentioned in the appointment letter.

      During the discussion, leaders apprised her of the agony and resentment resulted amongst the members of the association after publication of the Recruitment Rules (RRs) of Executive Assistant on 28th September 2015. It was also brought to her notice that no discussion was held with this association before finalisation of the said RR. A submission (Click here to see our submission Page-1 & Page-2) was handed over to her from this side and all the points were narrated to her. It was demanded, that the RR should be repealed. After giving a patient hearing, she agreed, in principle, that it would have adverse effect on the present Tax Assistants (TA) and suggested for sending their representation through respective Chief Commissioners and suggested that the representations by all the effected Tax Assistants be submitted to Board through respective Chief Commissioner.

    On giving promotion to the vacant pre cadre restructured post, she reiterated that the Board letter dated 17 September 2015 clearly states that the pre restructured posts would be filled up only as per the guidelines of RR of those posts.

     On relaxation issue, she asserted that the files are on the move and regarding promotion to the grade of CAO, she reiterated that the work is going on in full swing to give it effect at the earliest.

    A Model representation is being prepared and placed here in our next message for facilitation of instant representation by all effected TAs.

MESSAGE OF DELHI VISIT FROM 04.10.15 TO 06.10.15

 Dear Comrades,


This is in continuation of our earlier message date 09.10.2015.

The constituent Association of Joint Action Committee (JAC) in CBEC met on 04th Oct, 2015 in C.R. Building, New Delhi.  A review was undertaken to assess the developments on each of the demands placed by the JAC before the Board.  It was noted with concern that nothing much has happened since then although Board has issued a Minutes of the meeting held with the Hon’ble Chairman on 21.07.2015, the Minutes did not have any specific commitment.  It was unanimously decided to press for settlement of pending demands.  Some associations were of the view that the JAC should embark  on agitational programme to press for our demands.  Some others opined that we should prepare our organization and in the meanwhile negotiate with the Board to achieve in a time bound manner.  After threadbare discussions, JAC submitted a representation urging Board to take appropriate action with reference to our demands within a specific time frame (Representations of the Minutes is linked herewith).

   The leaders of the Association remained busy on 5th and 6th Oct, 2015, meeting with Senior Officers in the Board Office in connection with our various demands Shri Shankar Kr. Saha, Secretary General, Shri Ram Lalit, Assistant Secretary General (additional charge as Liaison Secretary), Shri Vikash Kr. Gupta, Organizing Secretary, Shri Indramohan (Liaison Secretary of Ahmedabad Unit) and Shri Prosenjit Pandey (General Secretary of West Bengal Unit) and Shri Anil Yerne.

                The leadership of the association met Member (P&V) on 5th Oct, 15 on the important issues Linked herewith.  It was informed that Board will now conduct the review DPC as well as DPC for promotion to Chief Accounts Officer (CAO).  We impressed upon them to conduct the same in a time bound manner as the same is already delayed by miles.  The association expressed its deep concern over the negative impact of the impending Recruitment Rules of Executive Assistant (EA) and Inspector.  It was pointed out that the report of the 7th CPC is epected any time and the Recruitment Rules would have to be reviewed after that.  Hence, it is not appropriate to issue new Recruitment Rules at this juncture (Click to see our submission).  It was also stressed to fill up vacancies on the basis of existing Recruitment Rules, even by granting relaxation to the eligibility conditions.

   This association also requested to issue a general instructions to all the field formations to give promotions to those officers who have passed the departmental even after 50 years of age as has been done in Delhi on the basis of judgement of Hon’ble High Court of Punjab & Haryana at Chandigarh (Click to see our submission)

   The association had its executive Committee meeting on 6th Oct, 2015.  Decision of which has already been placed in my earlier message.  The Minutes of which is linked herewith.

    It was also decided to hold a special meeting in the month of December, 2015. Bhopal Zone has given the initial concurrence to hold the meeting.

MESSAGE


Dear Comrades,
The Leadership of this Association undertook a visit to New Delhi from 04.10.15 to 06.10.15.  We attended the meeting of the Joint Action Committee (JAC), convened to review the progress of the action taken by the JAC on various issues. The executive committee of this association also met on 05.10.15 & 06.10.15.  The Minutes of both the meetings are being placed in due course.
  The leadership had meetings with Member (P&V) and other Senior Officers of Ad.IIA, Ad.IIIA/B Sections.  All necessary efforts have been put in to realize benefits on the basis of the RRs in operation before new RRs are implemented.  The relaxation of the RRs (in operations) has been stressed upon and the file is learnt to be under active consideration.  Besides, efforts have also been made to disentangle the problems with CAO DPC.  Other related issues have also been taken up.  Detailed reporting is being made in our next report.

  The executive committee decided to nominate Shri Shankar Kumar Saha, Assistant Secretary General to officiate as Secretary General in view of the fact that Mr. Samdani Khan, Secretary General has been promoted to the post of Inspector.  Shri Ram Lalit, AGS has also been given the additional charge of Liaison Secretary.  They have been advised to take necessary steps to address the problems of the Ministerial Cadre.  It was also decided to conduct a special meeting in December, 2015 along with all federating units.

MESSAGE OF DELHI VISIT FROM 14TH SEP TO 15TH SEP, 2015

Dear Comrades,


Our Association has always been proactive in settling the pending issues (as discussed in our earlier message).  Our Secretary General, G. Samdani Khan once again took the pain to visit to Delhi to meet Hon'ble Member (P&V) and other Senior Officers on 14th September & 15th September, 2015.  Shri T. Purushothama Reddy, Treasurer accompanied him.  Their visit has provided yet another persuasive push.

    The clarification of promotion to pre-restructured posts has been issued on 17.09.2015(as already posted).  We also expect the amendment of the Recruitment Rule of Tax Assistant by way of notification in Extra Ordinary Gazette in a few days.  This will facilitate promotion to Tax Assistant of LDCs by counting the service of Havaldar.  The Relaxation in the Recruitment Rules for pre-restructured posts are also being considered actively in the Board.  The Member (P&V) and other Senior Officers have assured a decision on this front.  

The visit of Secretary General has also given some momentum on DPC for promotion to Chief Accounts Officer.  He met DG (HRD) ADG (HRM) & DS, Ad-IIA on the issue.  We will hope to share some more information on the issue in our next message.

MEETING WITH BOARD CHAIRMAN & MEMBER (P&V) & SECRETARY (REVENUE)

Dear Comrades,

We met Hon’ble Member (P&V) on 21.07.2015 and Hon’ble Chairman on 23rd July, 2015.  All the meetings were held in a cordial atmosphere.  The Association expressed their opinion very strongly and ventilated the grievances of our members. 


Meeting with Hon’ble Member (P&V), CBEC ON 21ST JULY, 2015:

The representatives Mr. G. Samdani Khan ( Secretary General), Shri Shankar Kumar Saha (ASG), Shri Ram Lalit  (ASG) & myself of this Association met Member (P&V) 21st of July, 2015.  The meeting lasted for more than one hour as informed earlier four issues were taken up in the first place 1.Promotion to CAO 2.One Time Relaxation in RRs 3.Suitable clarification on Board’s letter dated 15.04.15 regarding re-designation of EA   4. Amendment in RR of TA.    The issues have been discussed threadbare.  The problems being experienced by the Board was shared.  The Association also on their part suggested the way out and the remedial measures. 

  1. DPC for Promotion to CAO for the vacancy years 2013-14, 2014-15 & 2015-16:
As far as the promotion to CAO is concerned the basic problem lies with the disparity in the Seniority List of A.O.s as the 37 names which were there in the previous Seniority List of Administrative Officers did not figure in the latest Seniority List published by the DGHRD that disparity has to be sorted out first for that, action has been taken on a war footing and it is expected that the revised and the corrected Seniority List would be finalized by DGHRD very shortly following which the proposal for promotion to CAO will take final shape.  The Member (P&V) has assured to take action expeditiously and the Association has also committed to co-operate and rather help the Board to the extent possible.

  1. One time Relaxation in RRs of Inspector, Stenographer, STA & TA:
As per as Relaxation to Recruitment Rules to facilitates promotions particularly to the post of Inspector is concerned the Member (P&V) wanted some more data to firm up the proposal so that it receives acceptance at the higher level.  Board wanted some more data like vacancies lying in the pre-restructured posts as well as in the post-restructured posts, the people who can be promoted by way of such relaxation.  The position as far as stagnations are concerned such data have to be collected from the zones for which letters have already been issued.  May I request the zonal leaders to follow the matter in their respective zones and ensure that the replies are sent as early as possible.

  1. To modify the Board’s letter dated 15.04.15 regarding re-designation of STA & DOS as Executive Assistant:
On the question of issuing a clarification for promotions to the pre-restructured posts on the basis of the existing Recruitment Rules.  The Member was apprised that the difficulties being experienced by some zones.  We also impressed upon her the need for a suitable clarification from the Board so that the promotion at the zonal level continues to take place on the basis of the existing Recruitment Rules.  The problems basically lies with the Board’s letter dated 15.04.2015 in which the post of Executive Assistant was stated to have been created w.e.f. the date of issue of the Cadre Restructuring order i.e. 18.12.2013.  We believe the post of Executive Assistant should be construed to have been created from the date of notification of Recruitment Rule which is yet to take place.  Hence, promotion can continue with the present Recruitment Rule.  The Member (P&V) has assured to look into the matter and necessary clarification to that effect.

  1. Amendment in RR of Tax Assistant, notified on 10.01.2014:
We were also informed that the Recruitment Rule of Tax Assistant is also being amended to include the service of Havaldar in the feeder posts.  This will also facilitate promotion to the post of Tax Assistant.  The file is informed to be pending with Ministry of Law and it was also informed that the Board will pursue to get it done as early as possible.
    
Special Drive for Direct Recruitment for the post of Tax Assistant:

The Association also took up the issue of Special Drive for direct recruitment of Tax Assistants (CLICK HERE FOR OUR SUBMISSION).  We highlighted that there are lots of vacancies in various zones particularly in the post of TA and it has become almost impossible to run the show with such a huge amount of vacancies at the field formations and at the very ground level.  It has resulted in unbearable pressure on the administration.  We have also written to take initiative for a Special Drive for recruitment in the post of Tax Assistant and which Member has also assured.

Counting of total service of DOS & STA for the purpose of promotion to Administrative Officer:

We also drew the notice of Member (P&V) to the fact that sizeable no. of vacancies lie in the post of Administrative Officer, which cannot be filled up for want of eligible DOS.  We requested that as per the guidelines of DoPT the officers who have worked more than 5 years in the Grade Pay of Rs.4200/- in PB-2 i.e. in the posts of STA and DOS taken together be considered for the post of Administrative Officer (CLICK HERE FOR OUR SUBMISSION).  In that event promotions can take place in various zones.  It is also learnt that some zones have already implemented this principle while granting promotions to Administrative Officer.  Member (P&V) assured to examine this issue. The meeting ended in positive note.  The Member said that she would try to do whatever doable and assured a regular interaction with the Association.

Meeting with Hon’ble Chairman, CBEC ON 23RD JULY, 2015:

Friends,
              As you are also aware that our Association is a part of Joint Action Committee.  Our leader is one of the joint convenor of the JAC.  The JAC had a meeting with Hon’ble Chairman at around 12’O Clock on 23rd July, 2015.  The 11 points agenda (already informed by our earlier message dated.29.06.15.) was the subject of discussions.  The meeting was attended by the Member (P&V) & Member (Central Excise) holding the charge of DGHRD.  Senior Board officials were also present in the meeting.  The representatives of all the constituent Associations attended the meeting.

   Each point was discussed separately.  The Chairman & the Members gave a patient hearing to our submissions.  The issues involve the common interest of the entire cadre.  The Chairman was very kind to inform us about the state of affair on GST and the larger role that the departmental officers have to play in the Post-GST scenario.  It was also assured that our concern on proper implementation of the recommendation of 7th CPC as well as detection of anomalies would be addressed after 7th CPC submits its report.  The precarious state of Ministerial Cadre in terms of Pay scale, hierarchy and the delayed promotions, have been highlighted in the meeting.  It was also assured that Minutes on each of the points will be issued which will form the basis for future action and negotiation.

Meeting with Secretary (Revenue) on 29.07.2015 at 3.30 P.M.:

The Joint Action Committee met Secretary (Revenue) on 29th July, 2015.  The issues raised by the JAC has once again been discussed with Secretary (Revenue).  The disparity between CBDT and CBEC has been highlighted.  Shri Ram Lalit represented our Association in the meeting.  The leaders from Superintendent Association, Customs Group-C non ministerial Association and Customs Ministerial Association also attended the meeting.

VISIT TO NEW DELHI FROM 21.07.15 TO 23.07.15 - MEETING WITH BOARD MEMBERS

Visit to Delhi from 08.06.15 to 11.06.15



Meetings with Board Officials:
Secretary General, Mr. G Samdani Khan along with Assistant Secretary General, Shri Shankar Kumar Saha and Shri Suman Sarkar from Kolkata, Assistant Secretary General, Shri Ram Lalit from Chandigarh and Organizing Secretary, Shri Vikas Kumar Gupta from Ahmedabad had been in Delhi from 08 Jun to 11 Jun 2015, to pursue various issues.  Appointments were sought from Hon’ble Chairman, Hon’ble Member (P&V) & JS (Adm.) of CBEC on the following agenda points and other miscellaneous issues: 
Gist of the discussions is given as below:
  1.   DPC for promotion to the grade to Chief Accounts Officer (CAO) from Administrative Officer (AO) for the vacancy years 2013-14, & 2014-15:
Since there has been a dispute arisen in the Seniority List of AOs, where 37 names have been reported to be omitted in the present updated Seniority List. The office of DGHRD was rigorously pursued to take necessary action to correct the situation (Click here to see our submission).  Accordingly a letter was issued on the very same day vide letter under F.No.8/B/78/HRD (HRM)/2015/ 2807 dated 09.06.2015 (Click here to see the Board letter dated 09.06.15). This Association requested to conduct the DPC at the very earliest by exploring all options. A submission has been put forward by this association to the concerned Authority for due consideration. It has been assured that the matter will be looked into on priority basis.

   2.  One time relaxation in Recruitment Rules  of Inspector, Stenographer, STA & TA due to Cadre Restructuring:
         
Issue of grant of one time relaxation, in the existing RR for promotion to the grade of Inspector, STA and TA, has been taken up with the Deputy Secretary and Under Secretary of AD-IIIA/B. They have been apprised of the situation, which will badly affect the working environment, due to shortfall of manpower in every cadre, if the relaxation is not granted (Click here to see our submission). They were apparently impressed and positive action is expected.

  3.  Re-designation of the posts of STA & DOS as Executive Assistant:

The confusion created among the field formations due to issue of Board’s Letter dated 15.04.2015 was once again brought to the notice of the Board and request was made to issue a clarification to the Commissionerates. A submission has also been made on this issue (Click here to see the submission).

   4.    Amendment/Rectification in RR of Tax Assistant, notified under GSR.12 (E) dated 10.01.2014 (Ad.IIB):

The combined service of LDC and Head Havalder for counting the qualifying service for promotion to Tax Assistant, notified in the recently published Recruitment Rule of Tax Assistant, has been not in order as pointed out many a times in the past, has been explained to the concerned officers. It has been requested to amend the RR be issued in near future, where the word ‘Head Havalder’ will be replaced by the word ‘Havalder’ (Click here to see our submission).

We also pursued to our earlier demands to incorporate a "Retention Clause" in the new Recruitment Rules of Inspector and Executive Assistant.

It is also requested to incorporate a clause in the upcoming Recruitment Rules, which will ascertain that while counting the qualifying service for promotion to next higher grade, the total service rendered in the same ‘Grade Pay’ will be considered, e.g. for AO promotion, the service rendered in the grade of STA and DOS will be counted as qualifying service.

Meeting with Hon’ble Member (P&V) on 11.06.15:

Members of the Association had a meeting with Hon'ble Member (P&V), CBEC, Ms. Vanaja N Sarna on 11.06.2015 in presence of the Deputy/Under Secretaries of AD-IIA/B, AD-IIIA/B and  AD-IV.  Madam wanted to know if this was the only Association for the Ministerial Cadre. It was clarified to her that it was the only Association of Central Excise and Service Tax Ministerial Officers (Click here to see the intimation letter of new Executive Committee).  She said that she had gone through all the issues, which were projected as Agenda Points for the meeting and accordingly instructed the concerned officers to put the files before her. The members were informed that a reply will definitely be given shortly about the status of the ongoing issues. Meetings ended with cordiality.

Samdani Khan, Organizing Secretary and other Comrades from West Bengal, Hyderabad, New Delhi and Punjab have been on the move over the last three days visiting the various formations of the Board (CBEC).  We summoned our all energy to pursue various issues, facing the well being of our members across the country.

During our visit, we met Member (P&V) and had detailed discussions with the Deputy Secretaries and Under Secretaries of Ad.IIA/IIIA/IIIB/IV on the following issues:-
(i)                 Relaxation in the existing RR.
(ii)               Framing of new RR.
(iii)              Promotion to CAO.
(iv)              Relaxation in the RR of AO.
(v)               Amendment in the RR of TA.
We have also submitted several representations which are linked with the message.
(i)   Relaxation in the existing RR:
The Association appreciates the cry of our members for relaxation in various form in the RR of Inspector for facilitations of promotions. But the unfortunate part is that replies to Board’s letter dated 09.02.2015 is wanting from many zones even after two and half months.  Basic data about availabilities of vacancies and proposals from the Chief Commissioners were called for.  In absence of the same, the proposals from the Board could not be firmed up.  It is expected that a reminder letter will be issued shortly and the zonal leaders make it a point to pursue with their zonal administration to send the desired report to the Board at the earliest.

It is also to be kept in mind that DoPT is not inclined to provide any relief in the old RR since the new one is already under consideration.  We need to get our act together to impress the Authority in this regard.  I hope the leadership will discuss the issue at length and take a call in the coming All India convention at Hyderabad to be held on 16.05.2015 (Saturday).

This Association requested to consider the following relaxations vide our submissions dated 23.04.2015 (CLICK HERE TO SEE):

(a) Relaxation in age and height restriction.
(b) Reduction in the length of qualifying service under the provision of clause 12 (c) from the present 10 years of regular service in the grade of TA to 05 years.
(c) Relaxation in the length of regular service of Senior Tax Assistant (STA) from 02 years to 01 year under clause 12 (b), having total service of 05 years including the service in the grade of Tax Assistant.
(ii)   Framing of new RR:
The RR of Inspector, Executive Assistant (EA) and Stenographer Grade-I are under active consideration at various levels.  We believe that some relief can only be provided if the “Retention Clause” is incorporated in the new RR.  These, we have been pursuing for quite some time.  However DoPT has to agree for that.  We have submitted yet another representation on the said subject (CLICK HERE TO SEE) and also discussed with the concerned officers.  I think that there is no room for complacency and the Hyderabad convention should deliberate the ways and means to achieve the same being of so much of vital importance for the future of the cadre.
(iii)   Promotion to CAO:
Despite our best efforts all necessary records are yet to be received by the Board as on 24.04.2015.   Some information are still wanting for 11 officers (CLICK HERE TO SEE Page-1 &Page-2).  Our Comrades from West Bengal, Delhi and Hyderabad zone have come forward to pursue the issue.  It is not possible to give any tentative deadline at this stage.   However the best efforts are on.
(iv)  Relaxation in the RR of AO:
      Board’s communication dated 15.04.2015 regarding re-designation of posts of Deputy Office Superintendent (DOS) and Senior Tax Assistant (STA) has created a great deal of confusion in various zones.  Decision of the government to re-designate such posts was taken in December, 2013.  It is not clear as to what prompted the Board to convey the said decision after one and half years, since it was initially conveyed on 18.12.2013.  Issue was appropriately taken up (CLICK HERE TO SEE).  It was pointed out that such re-designated post of Executive Assistant (EA) will only take effect from the date of notification of new RR.  It was also requested to fill up the vacant posts of Administrative Officer (AO) by relaxing the existing RR of AO.  The detail exercise is required to stake a stronger claim on the subject.

7th CPC

          As you aware that we have already given submission to 7th CPC.  We visited the office of 7th CPC in person and sought an appointment with them.  We also submitted the hard copy of our representation and met the officials.  It was assumed that appointment will be given to us with the Commission in their good office where sufficient time will be provided.

        May I request our members to come and deliberate at Hyderabad at length, so that we can take up all the issues appropriately before 7th CPC.
