Joint Action Council Agitational Program


Dear Comrades
 This Association is in receipt of a request from JAC leadership to participate in the agitational programme, finalised by them on 26.09.12. (Click here to view copy of the JAC letter and charter of demands) This was discussed with the office bearer who turned up at Delhi during the recent visit on 17.09.12 and 18.09.12.  I have also discussed the issue with President and other office bearer over phone.
           Accordingly, Unit Secretaries are advised to observe lunch hour demonstration and wear black batches on 26.09.12 along with other JAC constituents. They may take getting touch with local JAC members for this purpose.
It is further clarified that this agitational programme is finalised by the JAC constituents and we are to observe the same along with the other constituents, subject to the strength of local organisation vis-a-vis other organisations.
Participation in the JAC programme is taken to strengthen the unity and further the common cause.

Updates on Secretary General and Office bearers Delhi Visit


Dear Comrades,
            On 17th and 18th of this month, I along with Shri. Tarun Seal, Assistant Secretary General from Kolkatta, Shri. Deepak Pal, Organizing Secretary from Indore and Shri. Sheikh Ansar, Vice President from Bhopal and comrades from Nagpur, Indore, Bhopal and Kolkata visited New Delhi to take stock of the recent developments on some of the important issues related to Ministerial Cadre and to follow up various pending issues. A detailed submission was presented before the Board officials to settle the issues favorably (Click here to view the Copy of the letter)

             On the issue related to the DPC to the grade of CAO, all the deficiencies pointed out by UPSC have been cleared.  But unfortunately, it is noted that the file is yet to move out of Board office.  This association raised the issue strongly with the officials for necessary action, so that the DPC can be convened by the UPSC at the earliest.

            The issue related to promotion to the grade of AO is still unattended by the Board.  We raised our concern as hundreds of DOS throughout India are awaiting their promotions and the CCAs are expecting some directions from the board to convene the DPC.  It is quite amusing that the issue was wrongly interpreted and referred to the DoPT as Adhoc appointments by the Board.  The question of Adhoc-appointment in AO grade itself is an error.  These promotions right from 2008 were conducted on adhoc basis against regular vacancies for want of Recruitment Rules.  It is noted that some zones are conducting DPC on regular basis notwithstanding the Board’s letter dated 27.06.2012 and in some other zones DPCs were held and Adhoc promotions are being continued.  This association stressed upon the fact that an executive instruction may be issued by substituting the present DOS as feeder cadre instead of DOS L-I in the AO (RR) and regularize all the Adhoc promotions ordered from the year 2008.

         As regards the amendment to Recruitment Rules, this association emphasized that before any amendment in Recruitment Rules to various grades a consultation process should be initiated by the Board officials with the All India Association. 
             
             With regard to the issue of enhance of Grade Pay to DOS/ AO, the office bearers of this association had met the officials in the Department of Expenditure and requested that a positive approach should be adopted on the issue.  The All India Association has submitted a fresh memorandum to the Secretary, Expenditure and Joint Secretary (Personnel) to consider the grade pay issue positively (Click here to view the Copy of the letter).

        Further, the association requested the Board officials to bring up the seniority case pending with the Hon’ble Supreme Court before the ensuing cadre-restructure.  Our advocates were also consulted in this regard so that the case is finished at the earliest.  Needless to say, a favourable judgement in the case will reap us immediate benefits and also help our Ministerial cadre a lot in the long run of our career.  Hopefully, we can bring up the case for final hearing at the earliest.
            Regarding non-adherence of DoPT’s instructions by CCAs to conduct DPCs without delay, this association requested the officials to take necessary action and a time schedule be fixed to complete the pending DPCs.

Meeting with board officials at New Delhi


Dear Members

The undersigned along with the office bearers of our All India Federation intends to meet our C.B.E.C officials between 17th and 18th of September’2012.

The issues for discussion are detailed below

  • Promotion to the grade of Chief Accounts Officer (Central Excise)
  • Promotion to the grade of Administrative Officer
  • Amendment in Recruitment Rules to the grades viz. Inspector / STA / TA
  • Grade Pay in respect of AO / DOS / TA
  • Seniority case pending in the Hon’ble Supreme Court
  • Delay in conducting DPC for promotion in various cadre controlling authorities.

Dear comrades, the resolution and the minutes of the convention held at Indore on 25.08.2012 is given below.

“RESOLUTION ADOPTED IN THE CONVENTION HELD 
AT INDORE ON 25.08.2012.”
           
Delegates from different units, located all across the country, deliberated thread-bear on several issues and challenges, facing the ministerial cadre in CBEC on 25.08.2012 at Indore. After comprehensive and brain-storming parley, following resolutions have been adopted.

1.       All efforts would be redoubled to ensure the pending DPC for promotion to the grade of Chief Accounts Officer is held at the earliest. The Association shall pursue on a regular basis, so that the DPC for promotion to the grade of Chief Accounts Officer in future takes place in time.

2.       It was observed with great concern that the promotion to the grade of Administrative Officer, is held up in certain zones. In some other zones, it is being given on ad-hoc basis and in one or two zones, the same is granted on regular basis. The All India Association shall take all efforts so that the regular promotion to the grade of Administrative officer is made in all the zones on the basis of the existing Recruitment Rule.
3.       (A). The Association shall leave no stone unturned to achieve the higher grade pay of Administrative officer and Deputy Office superintendent. The judgement of Hon’ble CAT of Calcutta Bench will also be relied upon in this case.

                   (B). The Association shall also pursue the demand of higher grade pay of Rs. 2,800/- of Tax Assistant.

4.       The Association will also make suitable representation before the Board in the matter of Recruitment Rule of Inspector and Senior Tax Assistant which are presently being reframed.

5.       The Association shall also pursue on a regular basis for early settlement of Chennai
Seniority Case at Hon'ble Supreme Court.

6.       The Association shall also write to the Board with the request for suitable direction to all the zones for timely holding of DPC, compliance with all reservation norms, particularly those meant for Physically Handicapped persons and regular holding of JCM.

7.       The Association shall also endeavour to realize benefits for the members through the ongoing cadre restructuring process. Special emphasis would be given to achieve 100% promotion against all vacancies as happened in the last occasion.

8.       The All India Association shall also continue to pursue the issue of notional benefits in terms of seniority etc of those members who were promoted from Group-D cadre through implementation of the Judgement of Hon’ble A.P. High Court.



“Minutes of the discussion held during the convention 
at Indore on 25.08.12”

1.       Meeting started at 11 am at Hotel Kanha Garden, Indore.

2.     It was presided by Shri Ashim Pramanick, president whose name was proposed by Shri Nitin Jain, comrade from Indore and seconded by one and all.

3.    The welcome address was delivered by Shri Harihome Pande, comrade from Indore which provided the necessary spark.

4.      Thereafter, the zonal issues were taken up in the pre-lunch session on which the representative of each participating zones(as per enclosed list) deliberated. The acute stagnation of Nagpur-Bhopal-Indore-Raipur zone caught the attention of all.

5.    All India leaders responded to the queries and thereafter some points were noted for resolution.

6.  In the post lunch session Shri Ashim Pramanick, Shri Thomas Moni and Shri Sudarshan  apprised the meeting about the development on all the issues and steps taken by the association. The concern expressed by the delegates was taken note of and points were recorded for necessary incorporation in the resolution.

7.  After thorough discussion and satisfaction of the delegates, the president recorded the resolution.

8.       It was also decided that zones will undertake necessary initiative to address the zonal issues and All India Body will come for their support whenever required by the zones.

9.       The All India Body will also be taken into confidence before filing any O.A. by the zones. All India Body shall extend necessary support whenever possible.

10.   Lastly, the formation of the new committee was made on consensus and after consultation with all the zones, present.

11.   The meeting ended with the Vote of thanks from the host unit. The entire show was deftly managed by Shri Nitin Jain, comrade from Indore.

                The curtain was brought down on the convention at Indore on 25.08.12 with the chanting of the National Anthem “Jana Gana Mana”.
