Good Morning friends.

Extended Executive Committee meeting of the association was held on 19th January 2017 at CR building, New Delhi. Office bearers of national body and various zonal bodies and their representatives were present. The meeting was chaired by Shri Ashim Pramanick, President of All India Federation. In his inaugural speech, he reiterated that the renewal of recognition of all India federation is to be done on priority and without renewal of recognition; it would be difficult to pursue the issues with Board. Secretary General briefed the present status of all the issues and the exact demands of the association. Leaders present in the meeting agreed that the association should be strengthened and all the zones should be brought in the purview of the association. It was agreed that the signed annexure of respective DDO should be forwarded to organizing Secretary/Secretary General and the subscriptions of each zone should be deposited to the bank account of Federation by the end of February.

 All the pending issues with Board and future course of action were discussed. The leaders present in the meeting expressed their views on the issues and narrated the problems of their respective zone. It was opined that, we may have to consider the agitational programmes, if the Board continues to turn deaf ears to our legitimate demands. The option of going to CAT to remove the lacunae of recently published Recruitment Rules (RRs) of Inspector was also accepted, as last option, if Board does not give any favourable decision to the present stakeholders. The decision of joining other joint platforms like Joint Action Committee (JAC) and CoC in Department of Revenue has been endorsed in the meeting.

 The meeting ended with a cordial note after giving thanks to the chair.

           Joint Action Committee (JAC) in CBEC called an urgent meeting in CR Building, New Delhi on 03.02.2017. Shri Ram Lalit, Asst Sec Gen attended the meeting along with office bearers of Delhi zone. The meeting was chaired by Sh. S.K. Bansal, Secretary General, IRS (C&CE) Association. All the common issues were discussed, the minutes of which is given separately.

This association wrote numerous letters to honourable Chairman and Member (Admin) of CBEC to grant appointment to the office bearers to sort out the pending issues. In our letter dated 04/02/2017, we conveyed our decision to boycott Central Excise day celebration if we were not heard before 10th Feb 2017. A meeting was convened by honourable Member (Admin) scheduled on 10th February 2017 to discuss on all pending issues. Accordingly, Secretary General, Asst. Secretary General and Organising Secretary had been to Delhi to attend the meeting. The meeting was chaired by Honourable Joint Secretary (Admin) due to last moment change in the schedule of Member (Admin). However, it was conveyed that Madam would meet us again in the following week.

The minutes of the meeting, with Joint Secretary on 10th Feb, has been published but some of the important discussion took place in the meeting has not been reflected. The gist of the meeting on each issue is placed below:

Sepoy service counting with effect from 01.01.2006 :

It was informed that the order will be published on next working day with the date of effect from 29.8.2008 i.e. the date of notification of VI Central Pay Commission, as per instruction of DoPT. The order has already been issued.

Recruitment Rules (RRs) of E.A. :

Board is in the view that the RRs of EA has been prepared as per DoPT guidelines and was cleared by DoPT, UPSC and Law Ministry, so the amendment of RRs is difficult. We further demanded to fill the 40% direct vacancy quota by promotion as no recruitment has taken place since publication of new RRs on 28.9.2015. It was agreed by the chair and instructed the officers to examine it and also to put the proposal for one time relaxation.

Recruitment Rules (RRs) of Inspector :

It was informed that the comments were not sought because the proposal for amendment of RRs of Inspector has gone through DoPT, well before 31.12.2015, (date of DoPT guidelines for seeking comments). We brought the fact to the notice of the chair that since LDCE concept is not clear (who shall conduct, who is eligible, qualifying service, % of vacancies of DR quota etc.), the RRs is incomplete and it should be put on hold till the issue is settled and the promotion should be given on the basis of old RRs. The chair instructed to place the file with all the details and also to look into the relaxation aspect.

Recruitment Rules (RRs) of A.O. :

We have brought the fact to the notice of chair that even after completion of nine months since the comments were sought from the stakeholders, the RRs of AO has not been published and as a result, promotions are held up in various zones. We also demanded that till such time i.e. publication of new RRs, an instruction may be passed on the same line of new RRs (considering five years service in the same grade pay as qualifying service) so that the huge vacancies in the post can be filled up. It was also brought to the notice that such instruction was passed during the creation of post of Tax Assistant in 1987 and the RRs was published in 1996. The concerned officer sought one month time to finalize it or else the ‘issue of executive instruction’ may be considered.

All India Seniority List of A.O. :

We expressed our concern on the fact that the CAO DPC for about 200 vacant posts is held up due to the delay in finalization of A.I.S.L. of A.O. from 2009 onwards. The officer present from the O/o the DGHRD informed that the process of finalization is held up due to non receipt of desired information from a couple of zones. Hon’ble Joint Secretary (A) instructed the officers to put the issue on priority and to give him a regular feed back. It was also informed that since regularisation of ad hoc promotion of AOs was not granted uniformly across the zones, Board is trying to sort out the tangle. He also requested the association to contact the respective zones to forward the desired information at the earliest.

Interview for promotion to Gr. B and Gr. C posts :

The interview for promotion to Gr. B and Gr. C posts have been abolished w.e.f. 01.01.2016, vide Board order. However, in some zones, interview was being conducted while giving promotion on the basis of old RRs. A fresh clear instruction on this aspect is demanded. Chair agreed and directed the concerned officer to issue a fresh instruction at the earliest.

Instruction for conducting Pending DPC for all grades :

It was requested to issue the instruction for conducting DPC in all grades wherever DPC is held up for the want of RRs or any reason. It was assured that another letter will be issued on the same line as it was done on 02.8.2016.

The Office bearers also attended the meeting with honourable Finance Minister of India on 10th Feb 2017, along with JAC leaders, where besides GST related issues, the HR issues were discussed and we raised our concern about the disparity exists between CBEC and CBDT in respect of Promotional Prospect and Pay structures. Honourable Minister assured to look into each issue and expressed his concern.

Another meeting with Honourable Member (A) was held on 14th Feb 2017 at her chamber. Shri Ram Lalit, Asst. Sec. Gen. attended the meeting along with office bearers of All India Customs Ministerial Officers’ federation and the pending issues were discussed again in the meeting. It was expressed that regular meeting on pending issues will be held with recognised associations and updates will be provided. Minutes of the meeting is awaited.

It is once again requested to all the zonal leaders to collect the annexures of their respective zones and forward it by the end of this month for initiating the process of renewal of recognition.
