RESOLUTION ADOPTED BY THE JOINT ACTION COMMITTEE

Pune, the 2nd November, 2010

Dear members of the Ministerial Community,

         It is with deep regret that the undersigned wishes to place on the blog the recent developments that are taking place as regards the Cadre Restructuring of Central Excise & Customs Department is concerned.

         The sorry state of affairs have been very much evident during the previous Cadre Restructuring and though most of the conflicting issues are yet to attain finality, Recruitment Rules for the grades of Assistant Programmer, Programmer etc., are to be framed and notified even after nine years i.e. from 19.07.2001 the Board has embarked upon a massive restructuring proposal which is being kept confidential obviously meaning that the same is being done only to espouse the requirments of a particular cadre at large.

         While this Association, being a recognized body,has tried its level best to seek appointments as well as the form of proposed Cadre Restructuring, till date no positive steps have been initiated by the Board to involve the various Associations in the Cadre Restructuring process, thereby avoiding transparency in its functioning.

         An attempt to form a JAC did take shape, and owing to some reasons the undersigned could not make it to the JAC meeting held in Kolkatta on 31.10.2010. However, our Cadre was duly represented by our President Shri.Aasim Pramanik, who has been in constant touch with the undersigned both prior to and during the course of the meeting. The JAC has in its meeting dated 31.10.2010 passed a resolution which is being placed on the blog for kind information. Needless to mention, these are some of the issues which have been thought over and finalized by the office bearers of various Associations during their interaction in the JAC meeting.

         All the Office bearers of All India Association alongwith Unit representatives are required to be proactive to the need of the hour and ensure that the views/decisions placed on the blog is given wide exposure so as to ensure that the common members are kept updated with the latest developments.

        It is also felt that a meeting of all the Office bearers is considered necessary, for which an appropriate time and date shall be communicated in due course.

       Opinions/views on Cadre Restructuring as well as the aspirations of officers from the Ministerial Community needs to be shared with the All India Association at the earliest.

       While I personally opine that this is the right time to demonstrate unity, Associations irrespective of its recognition status need to come together, and impress upon the Board the need to maintain transparency in formulation of Cadre Restructuring Proposal by not restricting it to a particular Cadre but by taking into consideration the legitimate aspirations of each and every cadre. Last but not the least, the Board needs to be reminded of the positive attempts being put in by the Hon'ble Finance Minister in directing all concerned to reduce/avoid litigations on service matters by giving due cognizance to the aspirations of every cadres, thereby ensuring that the proposed Cadre Restructuring is free of litigations.

RESOLUTION

In the backdrop of the ongoing restructuring of the Cadres in CBEC , a joint meeting of the following Organisations/Federations held in Kolkata on 31.10.10 adopted the following Resolutions:

The Federations were present in the meeting:

1. All India Customs & Central Excise Group “D” Officers’ Federation.

2. All India Customs Group “D” Officers’ Federation.

3. All India Customs Ministerial Employees Federation.

4. All India Central Excise & Service Tax Ministerial Officers’ Association.

5. All India Central Excise Inspectors’ Association.

6. All India Customs Preventive Service Federation.

DEMANDS:-

1. Finalisation of the proposals of on going restructuring of cadres only after proper consultation (to be minuted) with respective Federations regard to cadre specific demand collectively and separately with cadre Associations/Federations.

2. A committee may be constituted with the representatives from the each Recognised Federations/ Associations and the officials from the CBEC to finalise the ensuing Restructuring of the Cadre of CBEC as done in CBDT (copy enclosed).

3. No reduction/abolition of posts in any of the grade belonging to Group ‘D’, Group’C’ & Group ‘B’ (Gazetted & Non-Gazetted).

4. Ensure atleast three promotions in the service life across the cadre.

5. One time relaxation for regularization of the daily wagers/casual labours through the on going cadre restructuring.

6. The vacancies that would crop up out of the cadre restructuring exercise should be first filled up by giving appointment to all the pending Compassionate cases as one time measure, disregarding the cap of 5 % of the Direct Recruit vacancies as provided in the relevant instructions.

7. Prompt and adequate consideration and redressal of the proposals submitted by the respective Federations/Associations in respect of ongoing restructuring of cadres of the CBEC.

8. Redefining of roles of employees in keeping with the procedural changes and deployment in an appropriate manner to all categories of Officers after proper training.

9. Restructuring of the cadres in consonance with the recommendation of the 6th CPC in chapter 3.1.

The meeting decided to go on an agitative programme of Mass Dharna in New Delhi on 24th & 25th November 2010 jointly if the above demands are not settled immediately.
