REDESIGNATION OF UDC (SPECIAL PAY) AS STA

2. Consequent upon issuing implementation orders in the case of Rashmi Arolkar V/s. UOI issued vide F.No.A.32018/1/2007-Ad.III A dated 09.10.2007, the Board had preferred a Special Leave Petition in the Hon’ble Supreme Court of India against the Hon’ble Chennai High Court order which came up for hearing on 04.04.2008 and directions were given by the Hon’ble Supreme Court to operate the disputed Recruitment Rules, under the condition that there would be no reversions.

3. The Board had further issued directions vide F.NO.A-23020/07/2007-Ad.III A dated 7th April, 2008 and 10th Sept’ 2008 to take necessary action to fill up the vacancies available in the promotion quota in the cadre of STA and Inspector as per the existing Recruitment Rules. Since no Executive Instruction can whittle down a statutory Recruitment Rule in force and considering the fact that the Recruitment Rules are being defended by the Central Board of Excise and Customs in the Hon’ble Supreme Court of India with the condition that there would be no reversions, it is once again requested that the interim orders of the Hon’ble Apex Court be followed in the right spirit, by withdrawing Board’s order dated 09.10.2007 till a decision is arrived at in the Seniority case.

4. It is also pertinent to mention here that some Commissionerates have reverted UDC (Special Pay) re-designated as Senior Tax Assistant to the grade of Tax Assistant whereas many Commissionerates have not reverted similarly placed officers owing to the relief granted by the Hon’ble Supreme Court of India and hence Board’s uniform directions in this regard is solicited please.

REQUEST FOR LIFTING OF BAN ON INTER-COMMISSIONERATE TRANSFER

Sub : Lifting the ban on Inter-Commissionerate Transfers - request thereof.

A settled decision of allowing Inter-Commissionerate Transfers in the various Group ‘C’ and ‘D’ posts based upon Board’s instructions dated 1980 has been unsettled by the Board by issue instructions to ban ICT w.e.f. 19.02.2004.

2. Inter-Commissionerate Transfers till 19.02.2004 were governed by Board’s earlier instructions contained in F.NO.A.22015/34/80-Ad.III B dated 20.05.1980 which clearly stipulated that the seniority of the transferred official would be fixed at the bottom of the respective seniority list. In other words, there was no protection of seniority and this instruction of the Board has stood the test of time and has been upheld by the Hon’ble Apex Court in a catena of decisions. However, the said consistent stand of the Department till 19.02.2004 has been changed owing to some Tribunal decision, which might not have been defended properly at the relevant point of time, because of which a haphazard decision was arrived at, to ban Inter-Commissionerate Transfers, though statutory provisions in the Recruitment Rules does provide for permanent absorption. Executive instructions cannot whittle down statutory provisions and therefore expecting legal relief on the unwarranted decision would prove futile.

3. More agonizing is the fact that the Board in its own wisdom chose to relax ICT ban on spouse grounds and portrayed its bounteousness by granting seniority to the officers who are getting transferred on spouse grounds without any mention whatsoever as to whether the said instruction superseded the Board’s earlier instruction dated 20.05.1980 or otherwise. While the said instruction is contradictory to earlier instruction dated 20.05.1980 as regards seniority is concerned and is also very silent about its retrospective or prospective application, the same has put the Board in a tight spot and would trigger fresh litigations which would be difficult to defend.

4. Considering the fact that there is a huge imbalance prevailing in the various Group ‘B’, ‘C’ and ‘D’ cadres, post restructuring, in the respective zones under Central Board of Excise and Customs and the fact that ICT terms and conditions stipulated vide Board’s instructions contained in F.NO.A.22015/34/80-Ad.III B dated 20.05.1980 has stood the test of time, a request is once again made to the Board to lift the ban imposed on effecting Inter-Commissionerate Transfers on Compassionate grounds, with the condition that the provisions incorporated by the Board in its instructions dated 20.05.1080 would prevail.

5. Hoping that the Board would consider the above mentioned request wisely rather than ignoring the same, time and again, as this would be in the overall interest of the Board.

REQUEST FOR RELAXATION FOR PROMOTION TO THE GRADE OF INSPECTOR

Kind reference is invited to Board’s recent letter whereby information was called for from the field formations to ascertain the number of officers who have been awaiting relaxation in Height parameter inorder to be considered for promotion to the grade of Inspector.

2. The Recruitment Rule for Inspector, Central Excise has been notified vide GSR No.494 dated 07.12.2002 which has been classified as General Central Service, Group ‘C’ Non-Gazetted, Non-Ministerial and the said Recruitment Rule has not been superseded and still in existence. As per DOP&T’s instructions issued vide CD.14017/10/85-Estt.(RR) dated 21.03.1985 and 05.06.1985, the respective Ministries/Departments have been delegated powers to frame/amend/relax provisions in the Recruitment Rules for Group ‘C’ and ‘D’ posts.

3. Considering the fact that numerous promotee quota vacancies in the post of Inspector are lying unfilled in many zones throughout the country, it would be in the interest of the Department that the relaxation proposed to be granted is done so at the earliest, which is a positive step initiated by the Department, thereby facilitating filling up of vacancies prior to embarking upon massive exercises like reorganization, GST etc. Moreover, the age old requirement to fulfill the said physical parameters as laid down in the Inspector Recruitment Rule is found to be obsolete, as the Department is more or less audit related and physical control is minimized to the maximum possible, thereby creating the need to re-look into the said issue with a broader perspective.

REQUEST FOR RELAXATION IN QUALIFYING SERVICE FOR PROMOTION TO THE GRADE OF INSPECTORS

Sub : Granting relaxation in qualifying service for promotion to the grade of Inspector..

The Recruitment Rule for Inspector, Central Excise notified vide GSR No.494 dated 07.12.2002 and classified as General Central Service, Group ‘C’ Non-Gazetted, Non-Ministerial has not been superseded and is still in existence. As per DOP&T’s instructions issued vide CD.14017/10/85-Estt.(RR) dated 21.03.1985 and 05.06.1985, the respective Ministries/Departments have been delegated powers to frame/amend/relax provisions in the Recruitment Rules for Group ‘C’ and ‘D’ posts.

2. Based upon the said DOP&T’s delegation of powers to the respective Department, this Association takes the opportunity to put forth the following facts for your kind information and suitable orders in this regard.

a. Prior to Cadre restructuring, the cadre of Tax Assistant, Upper Division Clerk and Lower Division Clerks were eligible to be considered for promotion to the grade of Inspector.
b. Post Cadre restructuring, all the stagnating Lower Division Clerks had to forego their numerous years of dedicated service put in the Department, only to get an alleviation to the grade of Tax Assistant and face the second round of stagnation owing to the mandatory 10 years eligibility condition laid down in the Inspector Recruitment Rule.
c. Owing to the deemed promotion, all the Lower Division Clerks, irrespective of the years of service put in, were either notionally promoted as Upper Division Clerks w.e.f. 2001 or 2002 and thereafter re-designated on 05.05.2003 or promoted as Tax Assistant during the year 2003.
d. As per Clause (c) under Column 12 of the Schedule to Recruitment Rule of Inspector, Central Excise, eligibility of Tax Assistants is not less than 10 years service including he service to be included for this purpose under the provisions of the rules regulating the method of recruitment to the post of Tax Assistant.
e. The Lower Division Clerks who had put in ample years of service were granted deemed promotion as Tax Assistant in 2003 and they put in only more than 6 years of service owing to which they are not eligible for promotion to the grade of Inspector.
f. Further, as per Clause (b) under Column 12 of the Schedule to Recruitment Rule of Inspector, Central Excise, eligibility of Senior Tax Assistant to the grade of Inspector is two years of regular service. Since numerous Tax Assistants throughout the country have been promoted as Senior Tax Assistants during the past two years, and as they have not completed 2 years of service as STA, they too are not eligible to be considered for promotion to the grade of Inspector.

3. It would be pertinent to mention here that though ample vacancies are existing in the promotee quota of Inspector, the same cannot be filled up for want of eligible officers as per the provisions incorporated in the Recruitment Rule of Inspector.

4. As per Rule 6 of GSR 494 notified on 07.12.2002, the Central Government is competent to relax any of the provisions of the rules with respect to any class or category of persons. Prior to cadre restructuring, Lower Division Clerks with 11 years service in the grade and 2 years as UDC were eligible for promotion to the grade of Inspector. On a similar analogy, Lower Division Clerks who have put in nearly 10 years service were granted deemed promotion to the grade of Tax Assistant during the year 2003, consequent upon which they have been working as Tax Assistant for more than 6 years, thus taking the total span of service to 16 years.

5. Considering the fact that the Department is required to meet the growing demands of the user-clients for much higher levels of facilitation, reliance on technology and having a motivated, committed and trained workforce, for which massive exercise of reorganization is being embarked upon by the Board, the said objectives obviously cannot be met with, by having a workforce which is low in morale and deprived of opportunities for a proper career building.

6. In view of the facts narrated above, the Board may like to grant a one time relaxation of 4 years in the qualifying service of Tax Assistants for being considered eligible for promotion to the grade of Inspector, including 2 years relaxation in the grade of Senior Tax Assistants, thereby ensuring that all the seniors i.e. Senior Tax Assistants with 1 ½ years or 6 months etc., etc., as the case may be, but who are senior to the Tax Assistants are also considered for promotion alongwith their juniors, who would be availing of the benefit likely to be granted by the Board, thus boosting their morale.

7. This Association is seeking the above mentioned relief for a majority of its members as a one time measure for the crucial fact that once the new Inspector Recruitment Rule is notified as a Group ‘B’ post, the Board would not be competent to relax the provisions of the said Recruitment Rule, once notified as it would fall in the jurisdiction of external Departments like DOP&T, UPSC etc., etc. and thereafter obtaining relaxations immediately on notification of new RRs would be next to impossible thereby resulting in non-filling of Inspectors vacancies and leaving behind frustrated and depressed officers to cater to the Departmental requirements.

8. Hoping that the Board would consider the genuine submissions put forth by this Association and anticipating a one time relaxation for its members before the advent of reorganization and introduction of GST, thereby boosting the morale of many officers in the Department.

MEETING OF THE ANOMALY COMMITTEE

Greetings to all of you,

The Association is in receipt of the notice of the Ministry regarding the meeting of the Departmental anomaly committee scheduled on 11th January, 2010, under the Chairmanship of Additional Secretary (Revenue) in North Block, New Delhi. The meeting has been convened to discuss the demands/anomalies that have been placed by various associations before the anomaly committee consequent to implementation of the recommendations of 6th Pay Commission.

One of the major demand the Association has made before the committee is for grant of Grade pay of Rs.4,800/- to the grade of Administrative Officer and Rs.4,600/- to the grade of DOS. Copy of the agenda/report showing demands and the analysis of these demands by the department/Ministry can be had from the undersigned on request at aiccemof@gmail.com.

Time and again requests for upgradation of the pay scale of the grade of DOS and AO on par with Inspectors and superintendents respectively had been placed before the Ministry. Unfortunately, the request did not yield the desired result. This position continues even today. While analyzing the demand for grade pay of Rs.4,600/- the department has indicated that
From time to time the Association has been demanding pay parity with Inspectors etc. This demand does not come within the definition of anomaly under recommendations of the 6th CPC”.
However, in the action to be taken column, it has been mentioned that
“The demand of the Association for pay parity with Inspectors of central excise has been raised by the Association. This can be considered separately by the CBEC.”

Here is a golden opportunity before all those who are concerned over the cadre, to put the best foot forward and make the demands more realistic with detailed justifications. The association intends to meet this demand by formulating a three point strategy. Firstly the existence of the posts of AOs and DOSs has to be justified based on the ratio of the subordinate officers whom they have to supervise. It has to be proved that the neither the posts of AOs and DOSs are on par with each other nor the merger of DOSs and STAs is feasible. Moreover, since the Department is becoming more or less Audit related, it would be a right step in reviving the post of Examiner in Audit Branch who can lead a team for revenue collection, thereby providing opportunities to those who have been deprived of getting into the Executive cadre owing to lesser height, age bar etc.etc. Secondly, the pay commission had in its recommendation indicated that the ministerial cadre cannot claim parity with the executive Officers. However, it has recommended parity with the counterparts of the Headquarters organization. This has to be the second point of strategy. Towards this we need to justify the nature of duties and responsibilites of the AOs and DOSs with that of the Section Officers and Assistants in the Central Secretariat Services, and simultaneously put in efforts to search for compile and forward the various pay upgradation orders issued by the Department of Expenditure in this regard. The third strategy is to compare these two posts with that of similarly situated posts in the other Central Government Departments i.e. Department of Posts/Telecom, Accounts and Audit department and the Ministry of Railways, where the similar posts have been granted upgradation.

Therefore, it is requested that all the members may kindly make sincere efforts to obtain documents in support of the above strategies. Copy of court orders or any other instructions of the Ministry may also be forwarded. All such suggestions, proposals may be mailed to the undersigned on or before 31st December, 2009, so that the same could be analysed and a detailed presentation with justifications can be placed before the anomaly committee.

Issues discussed in the meeting held at New Delhi

The Federation had been receiving requests from the members as regards the issues discussed in the meeting held at New Delhi in the middle of September-2009. Among others the following issues were taken up for discussion:-

a. Recognition of the Association :- The issue relating to recognition being a matter of concern for the entire cadre, was discussed and the types of queries raised in the file and the manner in which the said queries were resolved/answered was brought to the notice of all concerned. The then Joint Secretary(Admn) had a requirement of change in name from “Federation” to “Association” and thereafter he wanted to know as to how the Customs name could be incorporated in our Association’s name to which it was brought to his knowledge that the Land Customs is entirely different from the Air Customs. However, the Board desired a change of name to avoid confusion and accordingly the rechristened name as on this letter head was communicated to the Board. Thereafter, it was brought to the Association’s notice that another query was raised as to how our Association is attaining 35 % of the required membership to which suitable reply has been furnished by the Under Secretary and the file is under submission for recognition. The Organizing Secretary emphasized upon the fact that there are various units who have failed to conduct General Body Meetings and have not initiated salary deduction of its members owing to which the recognition issue is still pending finalization for want of achieving the 35 % target. She requested all the members present to initiate steps to interact with such units and activate them to hold General Body meeting and start salary deductions which would facilitate an early recognition.

b. Holding of CAO DPC :- The Association office bearers approached the Hon’ble Joint Secretary (Admn) and during the course of discussion apprised him of the issue relating to delayed holding of CAO DPC owing to which the upward mobility in the Ministerial mainstream gets affected. The Deputy Secretary, Ad.II A was also present during the discussion who informed that information was not received from some of the Commissionerates owing to which the delay occurred. However, an assurance was given that by the end of September, the file would be forwarded to UPSC for fixing a date of DPC.

c. Pay Scale of Admn. Officers and DOS :- Like the cadres of LDC, UDC and TA which got affected during the Cadre Restructuring exercise, the posts of Admn. Officers and DOS stand to get affected post implementation of the VIth Pay Commission recommendations. It was surely taken as a matter of great concern that the Admn. Officers and DOS who have worked for umpteen number of years in the Department are being equated with the STA’s as regards the Grade Pay is concerned, thereby bringing in a sense of resentment. The way files initiated by the Board for grant of higher Grade Pay to the Inspector/Admn. Officers were rejected was discussed. The Association Office Bearers also met the Hon’ble Additional Revenue Secretary who is the Chairman of the Anamoly Committee and apprised him of the genuine grievance faced by the Cadre and the manner in which two hierarchical posts of STAs are being placed in the same Grade Pay. The Secretary General stressed upon the need to have a comparative study of the issue as regards other Departments are concerned and take up the matter strongly with the Board once again. The President simultaneously kept the members informed that CBDT is also having similar demand and is likely to take the agitational path to maintain pressure tactics. Since the recognition of our Association is still pending decision, such a measure would not be possible from our end was the final conclusion. However, the President assured that a revised detailed proposal would soon be sent to the Board.
As already published on the previous blog, the Ministry has granted the grade pay of Rs.4600/- to all the Posts in the pre-revised scale of Rs.6500-10500/- . However, this is only half the job done. It has not addressed the full concerns of the DOS and AOs as a whole. The AO in P&T Department and the A.A.O(Assistant Accounts Officer) in Railways are drawing a Grade Pay of Rs.4,800/- and hence the AO in our Department is also liable to be paid Rs.4800/- Grade pay. The Commission had recommended that the ministerial cadre shall not be compared with the executive posts and will get pay on par with the Ministerial cadre in the Headquarters organisations. Therefore, we have to get these recommendations implemented so that the AOs can get Grade Pay of Rs.4800/- and the DOS can get Rs.4600/-. Members of the cadre may try and get copies of the notifications/OMs whereby the Grade pay of Rs.4800/- has been granted to the posts in the pre-revised scale of Rs.6500-10500/- in the ministerial cadre from the Railways, P&T, and the Accounts Departments. The same could be placed before the Anamoly Committee for consideration.

GRADE PAY OF 4600 TO POSTS IN THE PRE-REVISED SCALES OF 6500-10500

Placed below is the Ministry's order granting Grade Pay of Rs.4600 to all the posts in the Pre-revised scale of Rs.6500-10500, which include the posts of AOs, Inspectors and Private Secretaries in our department.

Subject:- Grant of the revised pay structure of grade pay of Rs.4600 in the pay band PB-2 to posts that existed in the pre-revised scale of Rs.6500-10500 as on 1.1.2006 and which were granted the normal replacement pay structure of grade pay of Rs.4200 in the pay band PB-2

Sixth Pay commission recommended merger of the three pre-revised scales of Rs.5000-8000, Rs.5500-9000 and Rs.6500-10500 and replaced them by the revised pay structure of grade pay of Rs.4200 in the pay band PB-2. Vide para 2.2.21 (v) of its report, the Commission recommended that on account of the merger of these 3 scales, some posts which constituted feeder and promotion grades would come to lie in an identical grade. The Commission gave specific recommendations in its Report granting higher grade pay of Rs.4600 to some categories of these posts. As regards the other posts, the Commission recommended that it should first be seen if the posts in theses 3 scales can be merged without any functional disturbance and if possible, the same should be done, Further, the Commission recommended that in case it is not feasible to merge the posts in these pay scales on functional consideration, the posts in the scale of Rs.5000-8000 and Rs.5500-9000 should be merged with the posts in the scale of Rs.6500-10500 being upgraded to the next higher grade in the pay band PB-2 with grade pay of Rs.4600 corresponding to the pre-revised scale of Rs.7450-11500. In case a post already exists in the scale of Rs.7450-11500, the posts being upgraded from the scale of Rs.6500-10500 should be merged with the post in the scale of Rs.7450-11500.

2. The above recommendations of the Sixth Pay Commission were notified vide para (ii), Section I in Parts B and C of the First Schedule to the CCS (RP) Rules, 2008. While Part B of the First Schedule of he CCS(RP) Rules relates to revised pay scales for common categories of staff, Part C notifies revised pay structure for certain posts in Ministries, Departments and Union Territories. The above provisions of the Rules specifically mentioned that upgradations in terms of para (ii) Section I may be done in consultation with Department of Expenditure, Ministry of Finance.

3. Consequent upon the Notification of CCS (RP) Rules, 2008, Department of Expenditure has received a large number of references from administrative ministries / departments proposing upgradations of the posts which were in the pre-revised scale of Rs.6500-10500 as on 1.1.2006 by been granting them grade pay of Rs.4600 in the pay band PB-2. The matter has been considered and it has now been decided that the posts which were in the pre-revised scale of Rs.6500-10500 as on 1.1.2006 and which were granted the normal replacement pay structure of grade pay of Rs.4200 in the pay band PB-2, will be granted pay of Rs.4600 in the pay band PB-2 corresponding to the pre-revised scale of Rs.7450-11500 w.e.f.1.1.2006. Further, in terms of the aforementioned provisions of CCS (RP) Rules, 2008, in case a post already existed in the pre-revised scale of Rs.7450-11500, the posts being upgraded from the scale of Rs.6500-10500 should be merged with the post in the scale of Rs.7450-11500.

4. Accordingly, in terms of Rule 6 of CCS (RP) Rules, 2008, revised pay of Government servants in the pre-revised scale of Rs.6500-10500 who were earlier granted grade pay of Rs.4200 and who have already exercised their option for drawal of pay in the revised pay structure in the format prescribed in the Second Schedule to the Rules, will be fixed again in accordance with illustration 4A annexed to CCS (RP)Rules, 2008.

5. In case of all such Government servants in the pre-revised scale of Rs.6500-10500 who were earlier granted grade pay of Rs.4200 and who had opted to have their pay fixed under CCS(RP) Rules, 2008, action as prescribed in this Department’s O.M. of even number dated 30th August, 2008 will be taken. In case a Government servant desires to revise his earlier option for coming over to the revised pay structure, he may be permitted to do so without any reference to this Department.

6. On account of pay fixation in the revised pay structure of grade pay of Rs.4600 in the pay band PB-2, arrears of pay will be recalculated and difference of arrears in respect of the entire amount will be paid immediately. The manner of drawal of arrears has already been indicated in this Department’s O.M. of even number dated 30.8.2008.

NOTICE OF THE MEETING OF THE FEDERATION

Dear Members,

Many of you may be aware of the recent developments that are affecting the career prospects as well as the financial implications of various grades in the Ministerial cadre. Some of the developments had been reported and placed on the website too. It is understood that the Department is not ready to heed to the genuine demands of the cadre.
